WHY IT IS IMPORTANT: THE REGULATORY OVERVIEW

On October 2nd, 2018, the EU VAT’s Quick Fixes were approved: transitional measures proposed by the European Commission aimed at facilitating the introduction of the new definitive VAT regime, with the main objective of combating VAT fraud and reducing VAT gap.

Among the regulatory simplifications, is the one concerning the evidence regime in intra-Community supplies.

A relevant element in intra-Community supplies is the proof that the goods have been transported to the EU Country of destination, to support the non-taxable regime and prevent the risk of fraud.
With EU Implementing Regulation 1912/2018, which introduced the new Article 45-bis, a list of documents deemed suitable to prove that the goods have been transported or dispatched to another Member State has been typified.

It is necessary to be able to prove that the transport of goods has taken place, always being able to give evidence of the documents considered relevant as proof of the transfer: therefore, it is necessary to implement processes to archive the documents constituting proof.
